Pixel Sand
By downloading, installing or playing Pixel Sand ("the Game"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Game.
These Terms apply to all users, including but not limited to players, account holders, and users who access the Game on any platform (iOS, Android, or web).
GANKO S.r.l. ("we", "us", "our") reserves the right to modify these Terms at any time. Your continued use of the Game after changes constitutes acceptance of the updated Terms. We will notify you of material changes through the Game or via email.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Game for personal, non-commercial entertainment purposes only.
You do not own the Game. You are granted a license to access and play it. All game content, including but not limited to characters, environments, code, graphics, music, story and mechanics, remain the exclusive property of GANKO S.r.l.

You are responsible for maintaining the confidentiality of your account credentials. You agree not to share your account with others or allow unauthorized access.

Violation of these conduct rules may result in immediate account suspension or permanent ban without refund.
4.1 Suspension for Violations
If we determine that you have violated these Terms, used cheats/exploits, engaged in account trading, or otherwise violated our conduct policies, we reserve the right to:
Account suspension or termination for violations is final. You will not receive a refund for in-app purchases when your account is suspended or terminated due to rule violations.
4.2 Voluntary Account Deletion
You may request account deletion at any time by contacting support@pixelsand.ganko.com. For more information, see our Data Deletion Policy.
When you voluntarily delete your account, you may recover certain in-app purchases (specifically: Ads Removal) through your Apple or Google account recovery process, as per their standard account recovery policies. This is a function of the app store platform, not our policy.
5.1 Season Pass (30 Days)
The Season Pass is a 30-day limited-time license that grants:
The Season Pass expires after 30 days from purchase and cannot be extended. No refund is available once purchased. The 30-day countdown is displayed in-game.
If your account is suspended or terminated for violations of these Terms, your Season Pass will terminate immediately and cannot be restored. No refund will be issued.
5.2 Ads Removal
The Ads Removal purchase grants a one-time permanent removal of advertisements within the Game.
Important: This purchase remains active for the duration of your account. If your account is deleted or suspended, the Ads Removal benefit expires and is not accessible.
If you voluntarily delete your account, you may be able to restore the Ads Removal purchase on a new account through Apple or Google account recovery, following their standard procedures for in-app purchase recovery.
No refund is available once the purchase is made.
5.3 In-Game Currency and Booster Packs
In-Game Currency (coins, gems) and Booster Packs are consumable items. Once purchased and used in-game, they cannot be refunded.
These items have no real-world value and cannot be transferred, sold, or used outside of Pixel Sand.
No refund is available for currency spent or boosters used. If your account is suspended for violations, any remaining currency will be forfeited.
5.4 General Refund Policy
Refunds for in-app purchases are processed according to Apple App Store or Google Play Store policies, not directly by us. If you believe you are eligible for a refund:
We comply with refund requests processed by the app store platforms. However, we do not issue direct refunds. The app store is the merchant of record for all transactions.
No refund is available for consumable items after purchase, even if unused.
We provide the Game "as-is" without guarantee of continuous availability. The Game may experience downtime, maintenance windows, bugs, crashes or unexpected interruptions.
We are not responsible for:
While we make reasonable efforts to back up data and maintain service availability, we cannot guarantee recovery of lost progress. We recommend avoiding large in-app purchases immediately before or after major updates.
All content in Pixel Sand, including but not limited to game mechanics, graphics, audio, story, characters, code and user interface, is the exclusive property of GANKO S.r.l. and is protected by copyright, trademark and other intellectual property laws.
You may not use Game content, screenshots, artwork or code outside of the Game for commercial purposes without explicit written permission from GANKO S.r.l.
You retain ownership of any non-game content you create (such as gameplay screenshots shared on social media), but grant GANKO a royalty-free license to use such content for marketing purposes.
THE GAME IS PROVIDED "AS-IS" AND "AS-AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
We disclaim all warranties, including but not limited to:
We do not guarantee that the Game will be free from bugs, errors, viruses or malicious code, though we make reasonable efforts to maintain security and stability.
TO THE FULLEST EXTENT PERMITTED BY LAW, GANKO S.R.L. SHALL NOT BE LIABLE FOR:
Even if we have been advised of the possibility of such damages, and even if the cause of action is based on contract, tort, strict liability or any other legal theory.
Our total liability to you for any claim arising from these Terms or the Game shall not exceed the amount you have paid us in the 12 months preceding the claim.
Some jurisdictions do not allow limitation of liability, so this clause may not apply to you fully.
You agree to indemnify and hold harmless GANKO S.r.l., its affiliates, and their respective officers, directors, employees and agents from any claim, loss, damage, cost or expense (including attorney fees) arising from:
We use automated and manual systems to detect cheating, account farming, exploit usage and fraud. This may include:
If we detect violations, we may suspend or ban your account immediately without prior notice. You will not receive a refund for in-app purchases associated with a banned account.
The Game is available worldwide, but may be restricted in certain jurisdictions due to legal or technical reasons. Your use of the Game is subject to the laws of your country of residence.
If the Game is prohibited in your jurisdiction, you should not download or use it.
The Game may contain ads, links or content from third parties. We are not responsible for third-party content, advertisements, privacy practices or terms.
If you click a third-party link or ad, you may leave the Game. Please review the third party's terms and privacy policy before interacting with them.
These Terms are governed by the laws of Italy, without regard to its conflict of law principles.
Any dispute arising from these Terms or the Game shall be resolved under the laws of Italy. You consent to the jurisdiction of Italian courts.
Before initiating legal proceedings, we encourage you to contact us at support@pixelsand.ganko.com to attempt resolution.
If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it valid, or if that is not possible, it will be severed. The remaining Terms will continue in full effect.
These Terms, together with our Privacy Policy and Data Deletion Policy, constitute the entire agreement between you and GANKO S.r.l. regarding the Game and supersede all prior agreements, understandings or communications.
We may update these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Game after changes constitutes acceptance of the updated Terms.
Material changes will be communicated through the Game, app store updates or email notification.
